Terms of Service

This document constitutes a legally binding agreement between you (the "Client") and SAMA Trucking & Hauling, LLC. By engaging our logistics, transportation, or hauling services, you acknowledge that you have read, understood, and agreed to the following service terms and contractual obligations.
1. Definitions
"Company" refers to SAMA Trucking & Hauling, LLC. "Client" refers to the shipper, consignor, or entity requesting transportation services. "Goods" refers to the cargo or freight entrusted to SAMA Trucking & Hauling for transport.
2. Scope of Services & Obligations
SAMA Trucking & Hauling agrees to provide transportation and logistics services as agreed upon in individual shipping orders. We operate in compliance with Federal Motor Carrier Safety Administration (FMCSA) regulations. The Client is responsible for ensuring cargo is properly packaged, labeled, and ready for transit at the scheduled pick-up time.
3. Rates, Charges, and Payment Terms
Standard payment terms are Net 30 days from the date of invoice unless otherwise specified in a written contract. SAMA Trucking & Hauling reserves the right to assess late fees on balances exceeding 30 days. Fuel surcharges will be applied based on national averages at the time of transport.
4. Bills of Lading and Shipping Documents
The Bill of Lading (BOL) shall act as the receipt of goods and the contract of carriage. In the event of any conflict between these Terms of Service and any shipping document issued by the Client, these Terms shall prevail unless a separate Master Service Agreement is in place.
5. Liability and Cargo Claims
Our cargo liability is governed by the Carmack Amendment. Maximum liability for loss or damage is limited to $100,000 per shipment unless a higher value is declared in writing prior to dispatch and additional insurance fees are paid. Claims for visible damage must be noted on the BOL at the time of delivery.
6. Insurance
SAMA Trucking & Hauling maintains comprehensive liability and cargo insurance. Proof of insurance (COI) is available upon request for active clients. We ensure our fleet and drivers remain in full compliance with state and federal insurance mandates.
7. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Florida. Any legal proceedings arising from these terms shall be conducted in the courts located in Hillsborough County, FL.
8. Force Majeure
SAMA Trucking & Hauling shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to: weather disasters, acts of God, strikes, port congestion, or government-mandated closures.
